Terms and Conditions

1. General

1.1. These terms apply to all services provided by Sparks Power Pty Ltd  to residential homeowners, tenants, landlords, and real estate agencies.
1.2. By engaging our services, you agree to these terms.
1.3. We reserve the right to update these terms at any time. The latest version will be available on our website

2. Quotes & Pricing

2.1. All quotes are valid for 14 days from the issue date.
2.2. Quotes are based on the provided information; additional work or unforeseen issues may result in extra costs.
2.3. Changes to the scope of work must be agreed upon in writing and may incur additional charges.
2.4. Prices are exclusive of GST 

3. Materials, Details, and Dimensions

3.1. The client shall provide all necessary dimensions and locations in adequate time to enable us to carry out and complete the works as agreed.


3.2 If specific measurements or details are not provided, we will not be held responsible for any necessary alterations. Any additional costs incurred beyond the provided estimate will be charged accordingly.

4. Booking & Appointments

4.1. Bookings are subject to availability and confirmed once scheduled.
4.2. We strive to arrive on time but are not responsible for delays due to unforeseen circumstances.
4.3. Safe and unobstructed access must be provided to the worksite. If access is denied, a call-out fee may apply.
4.4. For rental properties, we require property manager or landlord approval before starting any work beyond emergency repairs.

5. Payment Terms

5.1. Homeowners & Tenants: Payment is due upon job completion unless otherwise agreed.
5.2. Real Estate Agencies & Landlords: Payment terms are 30 days from the invoice date.
5.3. Late payments may incur interest at 2% per month.
5.4. Disputed invoices must be raised within 7 days of receipt.
5.5. For ongoing contracts with real estate agencies, a credit account may be established upon approval.

6. Cancellation & Rescheduling

6.1. Cancellations within 12 hours of an appointment may incur a fee.
6.2. We reserve the right to reschedule appointments due to unforeseen circumstances.
6.3. If a tenant is not available for an appointment, a rescheduling fee may apply.

7. Warranty & Liability

7.1. We warrant that all materials and workmanship conform to the AS/NZS 3000 Wiring Rules and relevant regulatory requirements

7.2 We provide a warranty of 12 months on workmanship. Manufacturer warranties apply to products used.

7.3 We do not provide any warranty on materials supplied by the client
7.4. Warranty is void if work is modified or repaired by another party.
7.5. We are not liable for pre-existing electrical faults or failures.
7.6. We are not responsible for damages caused by external factors (e.g., power surges, misuse).

7.7. We are not liable for any consequential, special, or contingent damages resulting from our work.
7.8. Our total liability, whether in contract or tort, shall not exceed 10% of the contract sum

8. Real Estate & Rental Property Specific Terms

8.1. All non-urgent work requires approval from the property manager, landlord, or real estate agency before proceeding.

8.2 It is the responsibility of the property manager and/or owner to arrange any Body Corporate approval for residences that have appointed Body Corporate

8.3 Tenants requesting work must obtain approval from their property manager before we can proceed, except in emergency situations.
8.4. If we attend a rental property for a job that has not been pre-approved, we may be unable to complete the work, and a call-out fee may still apply.
8.5. We require clear work order instructions from real estate agencies to avoid delays and misunderstandings.
8.6. We provide compliance checks (e.g., smoke alarms, safety switches) as per landlord and rental property regulations.

9. Safety & Compliance

9.1. Under the Electricity (Licensing) Regulations 1991, we are not permitted to connect or leave unsafe wiring or equipment connected to an electrical installation.
9.2. Customers must inform us of any known site hazards before work begins.
9.3. If we discover faulty or unsafe wiring/equipment during work, we are legally required to repair or isolate the issue and report it to the relevant authority.
9.4. If additional work is required to rectify unsafe wiring, the client agrees to cover these costs. If they refuse, we will isolate the affected circuit and report the matter.
9.5. Unsafe conditions may require work to be halted until resolved, which may result in additional costs.

10. Electrical Emergencies

10.1. Emergency call-outs are subject to availability and may incur higher service fees.
10.2. Priority service is available for real estate agencies with ongoing service agreements.

11. Data Privacy

11.1. Customer and property information is kept confidential and used only for service provision.
11.2. We do not share personal details with third parties unless required by law.

12. Governing Law

12.1. These terms are governed by the laws of Australia.
12.2. Disputes shall be resolved through mediation before legal proceedings.
